Appendix 523. Fences and walls.

  • 523.1 Height: The maximum height for fences or walls in the AC, HC, LI, and HI Districts shall be twelve (12) feet. In all other zoning districts, fences or walls shall not exceed eight (8) feet in height. No fence or wall shall be designed in a manner that obstructs the vision of vehicular traffic at street and/or driveway intersections.

    523.2 Front yard fences of the privacy type installed along property lines in any zoning district must;

    (A)

    Apply for a certificate of zoning compliance and building permit where required.

    (B)

    Provide a scaled site plan indicating setbacks, locations and elevations for fences that are required to obtain building permits/certificates of zoning compliance.

    (C)

    Privacy fences or walls installed in front yards are required to:

    1.

    Meet ten-foot setbacks from the road right-of-way or easement.

    2.

    Be properly maintained.

    3.

    Where legal nonconforming privacy fences that are properly maintained exist along adjacent front yard property lines, a "like type" fence may be installed provided it is no higher or extending no further towards the roadway than the existing fence, and the existing fence is not designed or located in a manner that obstructs the vision of vehicular traffic at a street and/or driveway intersection.

    4.

    A legal nonconforming front yard privacy fence or wall that is destroyed more than fifty (50) percent, not maintained, or removed, may not be replaced or "mirrored" to another non-conforming front yard fence. Replacement of front yard fences or walls must meet current regulations.

    5.

    Non-privacy type fences such as split rail, uncluttered chain link and picket fences with less than fifty (50) percent opacity placed in front yard are exempt from setback requirements.

    (D)

    Fences or walls installed in accordance with Section 527 of the Landscape/Buffer/Tree Ordinance shall meet all requirements of this section.

    523.3 Emergency access: All fences or walls shall be designed to permit emergency access to the enclosed area, whether by use of gate or a breakaway section.
