Appendix 602. Rules for interpretation of district boundaries.

  • Where uncertainty exists as to the boundaries of districts as shown on the official zoning map, the following rules shall apply:

    602.1 Boundaries indicated as approximately following the center lines or right-of-way lines of streets, highways, alleys, railways, or public utility easements shall be construed to follow such lines;

    602.2 Boundaries indicated as approximately following plotted lot or tract lines shall be construed as following such lines, whether public or private;

    602.3 Boundaries indicated as approximately following the incorporated area of county limit lines, military reservation boundaries, or special district lines, as amended from time to time, shall be construed to follow such lines;

    602.4 Boundaries indicated within the area known as the Atlantic Ocean shall be construed to be parallel to, and five hundred (500) feet seaward from mean high tide lines or marsh shoreline;

    602.5 Boundaries indicated as approximately following the center, mean high water mark, or shoreline of streams, rivers, canals, lakes, marsh areas, or other bodies of water, low land, or tidal areas, shall be construed to following such boundaries;

    602.6 Boundaries indicated as parallel to or extensions of features indicated in subsections 602.1 through 602.5 above shall be so construed. Distances not specifically indicated on the official zoning map, or in other circumstances not covered by subsections 602.1 through 602.5 above, the Board of Appeals shall interpret the district boundaries.
