Appendix 1201. Churches, synagogues, temples, and other places of worship.

  • A.

    Churches, synagogues, temples, and other places of worship may be permitted in all Residential Zoning Districts provided that:

    1.

    Such use is housed in a permanent structure that is not a dwelling unit meeting all applicable building code requirements for an institutional use.

    2.

    Such use is located on a lot not less than one and one-half (1½) acres in area.

    3.

    Minimum lot width shall be two hundred (200) feet.

    4.

    No structure on the lot is closer than thirty (30) feet to any abutting residential property line, and a fence or wall at least six (6) feet in height above finished grade is installed along all residential property lines.

    5.

    Parking shall be provided on-site in accordance with the parking standards of this ordinance.

    6.

    An on-premises private school, kindergarten, pre-school, nursery, or day care center, or fellowship hall/family life center shall be considered an accessory use to the principal use of the site; however, parking for such uses shall be provided on-site in accordance with the parking standards of this ordinance independently of the primary use.

    7.

    Cemeteries are permitted as an accessory use to any place of worship, provided the minimum lot area and setback requirements for the district in which the church is located are met. No portion of the cemetery may encroach into the required setbacks.

    B.

    Churches, synagogues, temples, and other places of worship may be permitted in all Commercial Zoning District(s) provided that:

    1.

    Such use is housed in a permanent structure meeting all applicable building code requirements for an institutional use.

    2.

    Such uses may be permitted within an existing storefront or tenant space provided the requirements of this subsection are met.

    3.

    If such use is in a detached structure, it shall be located on a lot conforming to the minimum area required for the district in which it is located.

    4.

    If such use is located in a detached structure, it shall be no closer than thirty (30) feet to any abutting residential property line, and a fence or wall at least six (6) feet in height above finished grade is installed along all residential property lines.

    5.

    Parking shall be provided on-site in accordance with the parking standards of this ordinance; however; may be located on an adjacent parcel or within one hundred (100) feet of the proposed use. Location of required parking off-site shall be permitted provided the location of the proposed parking has like commercial zoning as the principle parcel or is zoned one (1) of the classifications listed above and a copy of the lease/use agreement of such parking area is provided at the time of permitting.

    6.

    An on-premises private school, kindergarten, pre-school, nursery or day care center, or fellowship hall/family life center shall be considered an accessory use to the principal use of the site; however, parking for such uses shall be provided in accordance with the parking standards of this ordinance independently of the primary use and the provision of subsection 5., above, are met.

    7.

    Cemeteries are permitted as an accessory use to any place of worship, provided the minimum lot area and setback requirements for the district in which the church is located are met. No portion of the cemetery may encroach into the required setbacks.
