§ 10.5-18. Definitions.

  • For the purposes of this chapter, the following definitions shall be observed in the construction of this chapter:

    Acceptable waste shall mean ordinary household, municipal, institutional, commercial and industrial solid waste including, but not limited to, the following:

    (1)

    "Solid waste" as defined in this section.

    (2)

    "Construction and demolition waste" as defined in this section.

    Notwithstanding any provisions to the contrary, unacceptable waste, including hazardous waste, shall not be "acceptable waste" and is explicitly excluded therefrom. In addition, "industrial waste" materials are expressly excluded from the definition of "acceptable waste" and "industrial waste generators" as defined by S.C. Code, section 44-96-80(G), are not subject to the provisions of this article.

    Ashes shall mean that residue from the burning of wood, coal, coke or other combustible material.

    Biomedical waste shall mean waste that may contain human pathogens of sufficient virulence and in sufficient concentrations that exposure to it by a susceptible human host could result in disease or that may contain cytotoxic chemicals used in medical treatment.

    Construction and demolition debris/waste shall mean any type of solid waste resulting from any improvement to real or personal property or the destruction/demolition or removal of any structure, improvement or building onto real or personal property. The term "construction and demolition debris" shall exclude hazardous waste and such other solid wastes, which are excluded hereunder.

    County shall mean Horry County, South Carolina.

    Designated facility shall mean any solid waste facility(ies) owned and/or operated by the SWA, and/or public owned facilities designated by the SWA for the acceptance or disposal of solid waste and construction and demolition debris, including, but not limited to, landfills and transfer stations.

    Disposal shall mean the discharge, deposit, dumping, incineration, spilling, leaking or placing of any hazardous waste, solid waste, construction and demolition waste, sludge or septage into or on any land, air or water so that the hazardous waste, solid waste, construction and demolition waste, sludge or seepage or any constituent thereof may enter the environment or be emitted into the air or discharged into any waters, including ground waters.

    Hauler shall mean a person, firm, corporation or other entity that provides commercial collection and hauling service to collect, pick up, remove, transport and/or dispose or cause to be collected, picked up, removed, transported or disposed of any solid waste and/or construction and demolition debris generated within the county.

    Hazardous waste shall mean a waste substance or material in any physical state, designated as hazardous pursuant to S.C. Code, section 44-56-20(6) (Rev. 2006).

    Horry County Solid Waste Authority shall mean the Horry County Solid Waste Authority (SWA), a public corporation created pursuant to Horry County Ordinance No. 60-90 and any successor thereto or assignee thereof.

    Person shall mean any natural person, corporation, partnership, or sole proprietorship, association or other legal entity.

    Resource recovery shall mean the recovery of materials or substances that still have useful physical or chemical properties after serving a specific purpose and can be reused or recycled for the same or other purposes.

    Solid waste shall mean garbage, refuse, litter, rubbish or other waste resulting from industrial, commercial, agricultural or household activities not disposable by means of sewage system operated in accordance with state and federal regulations.

    Unacceptable waste shall mean that portion of waste which is not acceptable waste and includes, but is not limited to, sewage and its derivatives, agricultural waste, biomedical waste, special nuclear or byproduct materials within the meaning of the Atomic Energy Act of 1954, as amended, and hazardous waste.

    Waste shall mean solid waste, construction and demolition waste, biomedical waste, hazardous waste, agricultural waste and septic tank sludge, and includes both acceptable and unacceptable wastes.
