§ 12.5-155. Penalties and enforcement.

  • (a)

    A person who violates any of the provisions of this article shall be guilty of an offense, and, upon conviction, shall be punished pursuant to section 1-8 of the Horry County Code, except that a person who violates the prohibition in section 12.5-157(a) on appearing in a state of nudity in an adult entertainment establishment shall be guilty of an infraction punishable by a fine of fifty dollars ($50.00).

    (b)

    Any premises, building, dwelling, or other structure in which an adult entertainment establishment is repeatedly operated or maintained in violation of this article shall constitute a public nuisance and shall be subject to abatement proceedings in a court of competent jurisdiction. The county may take the appropriate action to recover the costs of the action taken to abate the nuisance.

    (c)

    The county's legal counsel is hereby authorized to institute civil proceedings necessary for the enforcement of this article to enjoin, prosecute, restrain, or correct violations hereof. Such proceedings shall be brought in the name of the county, provided, however, that nothing in this section and no action taken hereunder, shall be held to exclude such criminal or administrative proceedings as may be authorized by other provisions of this article, or any of the laws in force in the county or to exempt anyone violating this code or any part of the said laws from any penalty which may be incurred.
