§ 12.5-28. Electronic transfer of daily reports.

  • Every licensed pawnbroker shall, in addition to the above provisions, furnish to the chief of police or sheriff or the designated agent of the chief of police, a list of every article pawned or purchased with all information required by section 12.5-24 at the end of each business day, prior to 9:59 p.m. by electronic data submission through a modem or similar device, in such a format that the data is capable of direct electronic entry into the Horry County Police Department's computerized pawn system in the order required per the chief of police or his/her designated agent thereof.

    A pawnbroker is in violation of this section if required to electronically report to the chief of police, and the data is erroneous, duplicative, or in an incorrect or incompatible format, or if no electronic report of the transaction is transmitted. Failure to utilize an electronic data transmission system required by this section shall be grounds for revocation of the pawnbroker's license unless meeting exemptions.

    If, after establishing the format and requirements for the transmission of computerized reports of transactions, the chief of police alters the required format, pawnbrokers shall be given at least thirty (30) days to comply with the new format requirements.

    The chief of police, sheriff, or designated agent thereof, shall have the ability to create administrative regulations regarding this article, and any changes shall be made in writing, and all pawnbrokers shall have thirty (30) days to meet the new guidelines.
