§ 12.5-34. Prohibited acts.

  • No licensee may receive any item of property that possesses an inaccurate, altered or obliterated serial number or owner applied identification number or any item of property that has had its serial number removed. It shall be unlawful to accept any item or property normally manufactured with a permanently embossed or attached serial number, on which the serial number is missing, obliterated, defaced or otherwise altered.

    No person may pawn, pledge, sell, leave, or deposit any article of property not their own; nor shall any person pawn, pledge, sell, leave, or deposit the property of another, whether with permission or without; nor shall any person pawn, pledge, sell, leave, or deposit any article of property in which another has a security interest; with any licensee.

    A pawnbroker establishment may be open to the public only between the hours of 7:00 a.m. and 9:00 p.m. and shall not conduct pawnbroker transactions with the public at any other time.

    A pawnbroker shall not conduct business through the use of a drive-up window or other practice, service, or device that enables an individual to conduct business from a motor vehicle without leaving the motor vehicle.

    Failure or refusal to comply with these requirements is grounds for a forfeiture of the pawnbroker's license and occupation tax certificate.
