Appendix 727. Commercial Agriculture District (AG2).

  • Intent. The Commercial Agriculture (AG2) District is intended to provide opportunities to locate and develop businesses that are reliant on the uses permitted in the AG1 District; however, are generally characterized as being more agriculture-commercial in nature.

    727.1. Permitted Use[s].

    (A)

    Accessory farm uses, such as sheds, barns, lean-tos, shelters, cribs, stables, silos, grain bins, outside farm equipment/vehicle storage, etc.

    (B)

    Accessory residential uses, such as detached garages, storage sheds, workshops, and all other uses customarily associated with residential dwellings.

    (C)

    Accessory uses that are subordinate and incidental to any permitted use below and on-site signage in accordance to the provisions of Article 10.

    (D)

    Churches, synagogues, temples, and other places of worship subject to the provisions of Article 12.

    (E)

    Convenience stores with or without gasoline.

    (F)

    Auto/boat/motorcycle/recreation vehicle/truck/construction and farm equipment service and repair subject to provisions of section 1207.

    (G)

    Farmers' markets.

    (H)

    Feed and grain stores or suppliers.

    (I)

    Greenhouses and nurseries for the raising, care, selling, transporting and storing of plants.

    (J)

    Landscaping material suppliers.

    (K)

    Livestock/agriculture auction facilities, including corrals, fences, chutes, etc. that are necessary to carry out the sale of animals or farm products/equipment.

    (L)

    Produce, stockyards, or depots and the areas delegated for the sole purpose of holding produce, animals or other farm products for the purpose of transportation to another location or auction facility.

    (M)

    Public and semi-private cemeteries subject to the provisions of Article 12.

    (N)

    Retail agricultural establishments that sell products to the public that are harvested or grown on site.

    (O)

    Single-family homes (site built, manufactured, or modular).

    (P)

    Veterinary offices and animal hospitals, with or without boarding facilities; kennels, and dog training centers.

    (Q)

    Welding shops.

    (R)

    Contractor's offices with equipment storage.

    (S)

    Auto/boat/motorcycle/recreation vehicle/truck/construction and farm equipment sales.

    (T)

    Mobile home sales (new and used).

    727.2. Conditional Uses.

    (A)

    Animal production facilities for swine, poultry, or fowl with less than ten thousand (10,000) pounds of normal production animal live weight on site at any one (1) time provided that:

    1.

    Such use is located on a parcel no less than five (5) acres; and

    2.

    All structures associated with such use shall meet required setbacks from the exterior property lines.

    (B)

    Animal production facilities for swine, poultry, or fowl provided that:

    1.

    Such use is located on a parcel no less than ten (10) acres.

    2.

    All structures associated with such use shall meet required setbacks from the exterior property lines.

    3.

    The following regulatory information shall be provided for facilities where between ten thousand one (10,001) and two hundred fifty thousand (250,000) pounds of normal production animal live weight will be located on site at any one (1) time:

    a.

    A copy of the SCDHEC permit to construct the proposed facility; and

    b.

    A copy of the SCDHEC approved Animal Facility Management Plan (AFMP) for the facility; and

    c.

    A copy of any waivers approved by SCDHEC related to modifications in the required setbacks or other requirements as established in the SCDHEC regulations for such facilities; and

    d.

    Other applicable regulatory permits necessary for the operation of such facilities.

    4.

    The following regulatory information shall be provided for facilities where between two hundred fifty thousand one (250,001) and five hundred thousand (500,000) pounds of normal production animal live weight will be located on site at any one (1) time:

    a.

    Items a.—d. in sub-paragraph 1. above; and

    b.

    A copy of the Dead Animal (swine or other) Disposal Plan; and

    c.

    Plans and specification for all other manure treatment or storage structures, such as holding tanks or manure storage sheds not included in the AFMP; and

    d.

    A copy of the Emergency Plan for the facility.

    If a commercial poultry house or swine facility is damaged greater than fifty (50) percent or destroyed due to an act of nature (i.e. fire, flood, hurricane, tornado) or a catastrophic event and a building permit is obtained within twelve (12) months and construction is completed within twenty-four (24) months of such damage or destruction, the above standards shall not apply. This exemption; however, shall not relieve the property owner of having to meet all applicable building, zoning, or DHEC regulations in place at the time of reconstruction.

    (C)

    Beer, wine, and spirit production (production includes a facility used to process raw materials to finished product, and to age, bottle, store, and sell said products;, tastings; and retail sales of related merchandise provided that:

    1.

    The property includes land under cultivation.

    2.

    No distribution is allowed.

    (D)

    Accessory living quarters in conformance with the requirements of Article V, Section 509.

    (E)

    Raising, handling, and care of animals and livestock provided that:

    1.

    Such use may be the primary use, or an accessory to a residence.

    2.

    Such use is located on a lot of not less than one and one-half (1½) acres.

    3.

    Stable or shelter, manure piles, pits or bins shall meet a sixty (60) foot front setback, a twenty-five (25) foot side setback and a forty (40) foot rear setback.

    4.

    If operated for commercial purposes, minimum lot size shall be three (3) acres. Except Swine, poultry and fowl for commercial purposes refer to section 727.2(A) and (B).
